DJP’s Employment Law team provides local, regional and national companies, as well as individuals and governmental entities, with a wide variety of employment law services.  We represent employers and other clients in administrative proceedings before federal, state and local governmental agencies and in federal and state court litigation.  We consult with, and provide advice and training to, our clients regarding employee issues and other employment law matters.

DJP’s Employment Law Team also drafts for our clients employment and separation agreements, employee handbooks and policies and procedures manuals, and other employment related documents.  We represent employers regarding discrimination, harassment and retaliation complaints, wage and hour issues, immigration matters, workplace health and safety issues, and unemployment claims.

Significant Areas of Service

  • Investigating and representing clients in connection with complaints of employment or housing discrimination or harassment based on gender, race, color, national origin, age, religion, disability, sexual orientation or other protected classifications under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Equal Pay Act, the Fair Housing Act and other applicable federal and state laws.
  • Investigating and representing clients with respect to Americans with Disabilities Act issues, complaints and requests for accommodations.
  • Consulting with and representing clients regarding Family and Medical Leave Act matters.
  • Advising clients pertaining to overtime compensation, minimum wage, employee classification and child labor issues under the Fair Labor Standards Act and related state statutes, and representing clients in connection with Wage and Hour audits and FLSA litigation.
  • Preparing and enforcing employee agreements containing restrictive covenants, including (i) non-disclosure covenants prohibiting the unauthorized use of a company’s trade secrets, confidential information and inventions, (ii) non-compete covenants, and (iii) customer and employee non-solicitation and non-disparagement covenants.
  • Representing employers and individuals with complex and routine immigration matters, including (i) securing for U.S. companies and their foreign workers temporary employment authorization (such as H-1B, H-2B, L-1, E-1/E-2, E-3 and TN visas) and permanent employment authorization (Green Card) based upon employment; (ii) advising companies about complying with federal, state, and local immigration-related laws; and (iii) defending companies who have been targeted by government agencies for immigration-related enforcement actions.
  • Conducting employer audits, involving a review of a company’s employment law policies, practices and procedures, providing training to management personnel regarding employment law matters, and consulting with and counseling management and human resources personnel regarding employee issues.
  • Consulting with and defending employers on health and safety issues, including complaints filed with or by OSHA or similar state agencies.
  • Representing employers with respect to unemployment compensation claims.
  • Drafting employee handbooks, policies and procedures manuals, employment and separation agreements, consulting with employers regarding company policies, reductions-in-force and the requirements of the WARN act, and other employee matters, and investigating and advising employers regarding employee violations of company policies.
