Durham Jones & Pinegar Shareholder Wm. Kelly Nash, successfully defended a Southern Utah high tech corporate client and Marketing Vice President against several matters including, fraud, breach of a Software License Agreement contract, punitive damages claims and attorney fees (i.e., total exceeding $100,000).
The claims related to and alleged failure to timely deliver goods/services in the highly competitive medical industry. The Arbitrator ruled in favor of DJP’s clients as to all counts and entered findings consistent with the firm’s theory of the case on all substantive points.
Following the 12-hour trial and the Arbitrator’s conclusions, the client representatives variously acknowledged, “This was a hard and well fought victory!”, “It is great to see principles can still prevail in our morally decaying society!” and “Durham Jones was superb in preparation and execution!”
