We represent parties in all facets of Chapter 11 reorganization and Chapter 7 liquidation cases under the United States Bankruptcy Code. We also represent clients in out-of-bankruptcy workouts, receiverships and other domestic & cross-border insolvency cases, as well as in related litigation, appeals, transactional structuring and opinions.
Our bankruptcy lawyers are Ken Cannon, Lena Daggs, Ian Davis, Duane Gillman, Penrod Keith, Steve McCardell, Erven T. Nelson, Jessica Peterson and Michael D. Rawlins. We have represented clients in nearly every major Chapter 11 reorganization case and every major Chapter 7 liquidation case in Utah for the past 30 years, as well as in significant bankruptcy cases in other jurisdictions. We participate in local and national bankruptcy organizations and have served on rules committees for courts, taught bankruptcy law in professional seminars and law schools, and received individual recognitions for excellence.
We bring technical excellence, practical experience and strategic sense to resolving bankruptcy matters. We enjoy peer recognition unmatched by any other bankruptcy and creditor-debtor rights group group in Utah. Each of our shareholders is included in Utah Business magazine’s annual list of “Utah’s Legal Elite,” the Mountain States Super Lawyers list, and Best Lawyers. Best Lawyers ranked D|J|P No. 1 in Utah in Bankruptcy and Creditor-Debtor Rights Law for 2009, 2010, and again in 2011, ranking our attorneys as First Tier in the area of Bankruptcy and Creditor-Debtor Rights/Insolvency and Reorganization Law.
We represent debtors and creditors workouts, receiverships, assignments for the benefit of creditors, and other non-bankruptcy insolvency proceedings.
We represent debtors, secured and unsecured creditors, creditors committees, shareholders, asset purchasers, lenders, and trustees and examiners in all aspects of business reorganization cases under Chapter 11 of the United States Bankruptcy Code.
Two of our shareholders serve as panel trustees in Chapter 7 bankruptcy cases. We also represent other Chapter 7 trustees in bankruptcy cases throughout Utah and Nevada, assisting them in all aspects of their duty to investigate and recover assets for creditors and enforce bankruptcy law. For debtor clients, when other efforts have been exhausted, our bankruptcy attorneys help clients navigate the difficult decision to file Chapter 7. We work with you to prepare the documentation necessary to appoint a trustee and oversee the sale of assets in order to pay off debt.
Members of our bankruptcy group have been counsel in bankruptcy matters resulting in dozens of published opinions and have argued bankruptcy appeals at all levels, including the United States Supreme Court.
